Hart says the state never made such a pledge.<\/p>\n<p class=\"style184\">\u201cHart and assistant prosecutor Nancy Lamb attended the hearing to support the parents. They say it would be inappropriate for Kelly to be released, because she continues to publicly proclaim her innocence.<\/p>\n<p class=\"style184\">\u201c \u2018The parents know she is guilty,\u2019 Lamb told reporters before the hearing. \u2018They know what their children have gone through.\u2019<\/p>\n<p class=\"style184\">\u201cCheshire, continuing to maintain his client&#8217;s innocence, said Hart should have tried Kelly in court if he wanted to show she was guilty.<\/p>\n<p class=\"style184\">\u201c \u2018He was afraid to do that,\u2019 Cheshire said. \u2018And now he&#8217;s running around saying that since she won&#8217;t admit her guilt, she should not get paroled. I think that&#8217;s pretty pathetic.\u2019 \u201d<\/p>\n<p class=\"style173\" style=\"text-align: right;\"><em>\u2013 From \u201cParents oppose parole for Little Rascals operator\u201d\u00a0in the News &amp; Observer (April 12, 1994)<\/em><\/p>\n<p class=\"style184\">Pandering, bullying, grandstanding, double-crossing \u2013 in\u00a0<a href=\"http:\/\/www.littlerascalsdaycarecase.org\/?p=566\">thwarting Betsy Kelly\u2019s parole<\/a>, the Little Rascals prosecutors scored a grand slam of misfeasance.<\/p>\n<p class=\"style184\">Here\u2019s what Joe Cheshire recalls about that brutal day:<\/p>\n<p class=\"style351\" style=\"padding-left: 30px;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-567\" src=\"http:\/\/www.littlerascalsdaycarecase.org\/wp-content\/uploads\/2015\/12\/120716Cheshire.jpg\" alt=\"120716Cheshire\" width=\"120\" height=\"180\" \/>\u201cSimply taking that plea was distasteful to me, but when the awesome power of government meshes with the awesome power of the judiciary and neither want to find the truth, but instead to consummate a decided outcome, the individual gets ground up in the process.<\/p>\n<p class=\"style351\" style=\"padding-left: 30px;\">\u201cBetsy was desperate to come home and did not trust anyone, nor should she have.\u00a0 I am not a fool; I would not have agreed to such a plea if it did not insure her freedom.\u00a0 The only (apparent) risk was the Parole Board.\u00a0 The prosecutor had agreed to not oppose her parole, but then he reneged.\u00a0 He knew that our only alternative was to move that the plea be set aside and that we would not be in a position to do that.<\/p>\n<p class=\"style351\" style=\"padding-left: 30px;\">\u201cYes, in retrospect I should not have trusted him&#8230;.\u00a0 But he was not willing to put it in writing, and (insisting on that) would have ended the negotiations&#8230;.\u201d<\/p>\n<p class=\"style184\">Little Rascals prosecutors seemed perversely unable to let any defendant go home without administering a final cheap shot. When Scott Privott was released under a no-contest plea deal in 1994, they added a last-minute stipulation that he undergo psychiatric evaluation as part of his five-year probation.<\/p>\n<p class=\"style184\">\u201cI saw them weekly for about two months,\u201d Privott recalls, \u201cand then they reported that I was normal.
