{"id":1079,"date":"2013-09-23T10:36:53","date_gmt":"2013-09-23T10:36:53","guid":{"rendered":"http:\/\/www.littlerascalsdaycarecase.org\/?p=1079"},"modified":"2016-01-17T15:50:44","modified_gmt":"2016-01-17T15:50:44","slug":"when-will-wheels-of-justice-turn-for-junior","status":"publish","type":"post","link":"https:\/\/www.littlerascalsdaycarecase.org\/?p=1079","title":{"rendered":"When will wheels of justice turn for Junior?"},"content":{"rendered":"<p class=\"style187\" style=\"text-align: right;\">Sept. 23, 2013<\/p>\n<p class=\"style184\">There\u2019s a bit of an update out of Raleigh on Junior Chandler\u2019s\u00a0<a href=\"http:\/\/www.littlerascalsdaycarecase.org\/?p=1058\">prospects for clemency<\/a>.<\/p>\n<p class=\"style184\">Billy Chandler, Junior\u2019s brother, received this email last week from Pat Hansen in the\u00a0<a href=\"http:\/\/www.doc.state.nc.us\/clemency\/index.htm\" target=\"_blank\">Governor\u2019s Clemency Office<\/a>:<\/p>\n<p class=\"style372\">\u201cAttorney Mark Montgomery filed a commutation request with this office at the end of Governor Perdue\u2019s term in office.\u00a0 However, due to the volume of requests received, the request was not \u2018officially reopened.\u2019\u00a0 Currently, we are working on all of the cases held over from the Perdue Administration.\u00a0 Unfortunately, I cannot tell you when your brother\u2019s case will be reviewed.\u201d<\/p>\n<p class=\"style184\">In North Carolina the governor\u2019s clemency power covers both pardons and commutations. Here\u2019s the stated distinction:<\/p>\n<p class=\"style184\">\u201cCommutation \u2013 whereby an individual presently incarcerated and serving an active sentence has their sentence commuted or reduced by any number of years, months, or days, or to make parole eligible, or to time served which would release the individual immediately.<\/p>\n<p class=\"style184\">\u201cPardon \u2013 may be granted to those individuals who have maintained a good reputation in their community, following the completion of their sentence for a criminal offense.\u00a0 Ordinarily, an applicant must wait to apply until at least five years have elapsed since the applicant was released from State supervision (including probation or parole).\u00a0 A Pardon is merely an official statement attached to the criminal record that states that the State of North Carolina has pardoned the crime. A Pardon does not expunge or erase a criminal record&#8230;.\u201d<\/p>\n<p class=\"style184\">As much as the facts of Junior\u2019s case call for a pardon, a commutation seems not quite as steep a challenge.
