{"id":117,"date":"2011-10-17T10:53:35","date_gmt":"2011-10-17T10:53:35","guid":{"rendered":"http:\/\/www.littlerascalsdaycarecase.org\/?p=117"},"modified":"2015-12-23T10:55:50","modified_gmt":"2015-12-23T10:55:50","slug":"n-c-law-stacked-deck-against-defendants","status":"publish","type":"post","link":"https:\/\/www.littlerascalsdaycarecase.org\/?p=117","title":{"rendered":"N.C. law stacked deck against defendants"},"content":{"rendered":"<p class=\"style67\">Oct. 17, 2011<\/p>\n<p class=\"style65\">The two largest ritual-abuse day-care cases \u2013 Little Rascals in Edenton and McMartin in California \u2013 bore many similarities but McMartin resulted in not a single conviction.<\/p>\n<p class=\"style65\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-118\" src=\"http:\/\/www.littlerascalsdaycarecase.org\/wp-content\/uploads\/2015\/12\/111017Montgomery.jpg\" alt=\"111017Montgomery\" width=\"100\" height=\"150\" \/>I asked Mark Montgomery, who in 1995 successfully argued Bob Kelly\u2019s case before the North Carolina Court of Appeals, why that might have been:<\/p>\n<p class=\"style65\">\u201cEach state has its own criminal laws, rules of procedure and evidence, etc. &#8230; Several features of the law in North Carolina gave prosecutors an advantage.<\/p>\n<p class=\"style65\">\u201cFirst, the prosecution interviewed all the children attending Little Rascals Day Care. Most said they had seen no abuse. The law allowed the prosecution to withhold those interviews from the defense. And the defense was not allowed to interview the children. So all the jury heard were the stories of the 12 children who were the subject of indictments.<\/p>\n<p class=\"style65\">\u201cSecond, the law allowed the state\u2019s expert witnesses to testify that they believed the children\u2019s claims.<\/p>\n<p class=\"style65\">\u201cThird, the defense was not allowed to conduct its own physical or psychological examinations of the children.<\/p>\n<p class=\"style65\">\u201cFourth, North Carolina had (and has) very liberal rules for the admission of hearsay by children in these cases. Almost anything a child says out of court can be used by the jury as substantive evidence of guilt. An effective prosecution strategy was to enlist the parents to elicit allegations of abuse. For months, parents, who were told their children had been abused, pleaded with their children to \u2018disclose.\u2019 Some eventually did.
