If a sitting prosecutor asks the appropriate court to vacate the judgment and dismiss the charges against a defendant \u2026 it will happen.\u2019<\/p>\n<p>\u201cBut this requires political will. And too often, the will is not there. As (Keith Hampton, attorney for <a href=\"http:\/\/www.littlerascalsdaycarecase.org\/?p=2033\">Fran and Dan Keller<\/a>)\u00a0notes, convincing a prosecutor that an injustice has happened can be a tough pull: \u2018Unless you have DNA \u2013 unless you get the DA completely cornered \u2013 there are no profiles in courage out there,\u2019 he says.<\/p>\n<p>\u201cStill, the number of exonerations in cases where no crime was actually committed are on the rise \u2013 so at least in some jurisdictions, individuals aren\u2019t forever left in the kind of limbo in which the Kellers find themselves.
