{"id":602,"date":"2012-08-15T02:19:10","date_gmt":"2012-08-15T02:19:10","guid":{"rendered":"http:\/\/www.littlerascalsdaycarecase.org\/?p=602"},"modified":"2016-01-12T20:38:08","modified_gmt":"2016-01-12T20:38:08","slug":"court-cracks-door-can-junior-fit-through-it","status":"publish","type":"post","link":"https:\/\/www.littlerascalsdaycarecase.org\/?p=602","title":{"rendered":"Court cracks door \u2013 can Junior fit through it?"},"content":{"rendered":"<p class=\"style187\" style=\"text-align: right;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-345\" src=\"http:\/\/www.littlerascalsdaycarecase.org\/wp-content\/uploads\/2015\/12\/120123Chandler.jpg\" alt=\"120123Chandler\" width=\"120\" height=\"180\" \/>Aug. 15, 2012<\/p>\n<p class=\"style184\">The North Carolina Supreme Court won\u2019t release its next batch of opinions until\u00a0<a href=\"http:\/\/appellate.nccourts.org\/petitions.php\" target=\"_blank\">August 24<\/a>, but its recent decision on a 2009 child sex abuse case could augur well for\u00a0<a href=\"http:\/\/www.littlerascalsdaycarecase.org\/?p=385\">Junior Chandler<\/a>.<\/p>\n<p class=\"style184\">On June 14 the court upheld the North Carolina Court of Appeals\u2019 overturning of\u00a0<a href=\"http:\/\/mtairynews.com\/archive\/11382\/view-full_story-19593310-article-new_trial_ordered_in_sex_case\" target=\"_blank\">Patrick Loren Towe\u2019s conviction<\/a>\u00a0in Surry County. Here\u2019s the crucial part of\u00a0<a href=\"http:\/\/www.leagle.com\/xmlResult.aspx?xmldoc=In%20NCCO%2020110315506.xml&amp;docbase=CSLWAR3-2007-CURR\" target=\"_blank\">the opinion<\/a>:<\/p>\n<p class=\"style268\">\u201cUnder the North Carolina Rules of Evidence, a qualified expert may testify as to her opinion in her field of expertise if the testimony will assist the jury in understanding the evidence. An expert may not, however, testify as to the witness\u2019s credibility or state that she believes the defendant is guilty.<\/p>\n<p class=\"style268\">\u201cIn sexual abuse cases involving child victims, an expert may not testify that sexual abuse has occurred without physical evidence supporting her opinion. An expert may not testify that the child has been \u2018sexually abused\u2019 if the testimony is based solely on the interview with the child-victim.\u201d<\/p>\n<p class=\"style184\">In Patrick Towe\u2019s case, only one expert witness so testified \u2013 in Junior Chandler\u2019s it was\u00a0<em>six<\/em>.<\/p>\n<p class=\"style184\">Without such a parade of \u201cexpert vouching,\u201d Junior surely would have spent the past 25 years back home in Madison County instead of behind bars.
